Player agreement
In exchange for being permitted to participate in the Hawaii Volleyball Combine, Player and her Parents and/or Guardians (collectively referred to herein as “PLAYER”), hereby pays the applicable registration fee and acknowledge, understand, and agree that Player would not be permitted to participate in the Combine unless they agree to the terms and conditions in this Player Agreement, and therefore PLAYER voluntarily and knowingly agrees to each of the following terms and conditions:
PLAYER acknowledges and understands that (a) there are certain inherent risks of injury, dangers and hazards associated with participating in the activities at the Combine and that such risks may be significant, including the potential for serious injuries, permanent injuries, viruses, and even death, including but not limited to bodily injury, concussions, strains, broken bones, fractures, ACL/MCL injuries, partial and/or total paralysis, viruses, death, or other injuries that could cause serious disability; (b) these risks and dangers may be caused by the negligence of the people running the event and/or persons assisting or participating in the same, the negligence of others, accidents, breaches of contract, the forces of nature or other causes; and (c) risks and dangers may arise from foreseeable or unforeseeable causes including but not limited to, balls striking PLAYER, equipment failing on PLAYER, PLAYER failing or bumping into others, equipment or facilities, PLAYER falling, running, jumping, landing or diving towards or away from a ball, consuming food or beverages at the event, decision making including how long sessions should run and such other risks, hazards and dangers that are integral to running such events.
Despite these inherent risks, PLAYER knowingly and voluntarily assumes all such risks, whether known and unknown, whether caused in whole or in part by the negligence of any entities or persons assisting, planning, instructing, volunteering, or working at the Combine and/or at any concession (collectively referred to as "the combine"), and assumes full responsibility and risks relating to PLAYER's participation at the Combine. In exchange for PLAYER being allowed to participate in the Combine, PLAYER, on behalf of herself, her heirs, assigns, personal representatives, legal representatives and next of kin, hereby knowingly and voluntarily COMPLETELY RELEASES everyone associated in any way with the Hawaii Volleyball Combine including but not limited to The Hawaii Volleyball Foundation, The Hawaii Volleyball Combine, The Hawaii Volleyball Showcase, Volley Hawaii, participating Volleyball Clubs, Colleges, Universities, College Coaches, Combine Coaches, The USAV Aloha Region, The USAV, The Juniors Volleyball Association, vendors, the State of Hawaii, City and County of Honolulu, and each of the aforementioned’s respective owners, officers, directors, members, managers, employees, organizers, planners, coaches, agents and volunteers, from ANY AND ALL CLAIMS OR LAWSUITS OF ANY TYPE WHATSOEVER, for any and all types of damages to include but not limited to personal injuries, death, property damage, illnesses, viruses, economic and/or educational opportunities and/or economical damage to PLAYER arising out of or relating to the Combine, and also agrees to defend and indemnify said released parties from all claims or lawsuits that may be brought on her behalf relating to any injury, death or damage to PLAYER and/or to her family members or friends, arising out of or relating to the Combine.
PLAYER understands and recognizes that while college teams have committed to the combine, their plans may change and as a result may not ultimately attend the combine.
PLAYER also understands and agrees that due to viruses such as the COVID-19 coronavirus or other unanticipated causes, the date or location of the combine may be moved and/or the combine may be converted to a live-streamed event, in which case refunds will not be issued because substantial expenses will have already been incurred by that time.
PLAYER understands that refunds shall only be given upon receipt of a written request with a physician's disability certificate dated before January 30, 2024, certifying a disabling injury.
PLAYER understands and agrees that her Player Registration may be forwarded to University Athlete for the limited purpose of private viewing by college coaches relating to the Combine to assist coaches in evaluating PLAYER.
PLAYER agrees that the Hawaii Volleyball Combine, Volley Hawaii, the Hawaii Volleyball Foundation, the Hawaii Volleyball Showcase, and their sponsors may use pictures and/or videos taken of PLAYER at the combine for promotional purposes and/or may post, repost, or retweet high school, club, collegiate, or professional volleyball related posts of PLAYER.
PLAYER HAS READ, UNDERSTANDS, AND AGREES WITH EACH OF THE TERMS OF THIS AGREEMENT, AND ACKNOWLEDGES THAT BY REGISTERING FOR THE COMBINE SHE CONFIRMS HER AGREEMENT TO EACH OF THE TERMS AND CONDITIONS IN THIS AGREEMENT AND THAT SHE CAN NEVER DISPUTE THE VALIDITY OF ANY PORTION OF THIS AGREEMENT.
